Terms of Service for CallYou

Welcome to CallYou VoIP Services. These Terms of Service ("Terms") govern your use of CallYou VoIP & CallYou VoIP Pro ("CallYou", "we", "us", or "our") virtual phone number, voice calling, and text messaging services (the "Services"). By using our Services, you agree to be bound by these Terms.

1. Service Description

CallYou provides Voice over Internet Protocol (VoIP) services including:

Virtual Phone Numbers: We provide virtual phone numbers that can be used to make calls
Voice Calling: Domestic and international voice calling services
Caller ID: Display your virtual number when making calls

2. Eligibility and Account Registration

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

3. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in accordance with these Terms. You shall not:

Use the Services for any illegal activities or to violate any laws or regulations
Send spam, unsolicited communications, or engage in telemarketing
Harass, threaten, or abuse others through voice calls or text messages
Use the Services to impersonate others or misrepresent your identity
Attempt to gain unauthorized access to our systems or other users' accounts
Use automated systems to make excessive calls or send messages
Transmit viruses, malware, or other harmful content
Use the Services for emergency services (911 calls) - see Emergency Services section

4. Virtual Phone Numbers

Number Assignment: Virtual phone numbers are assigned to you for your use during your active subscription. Numbers are not owned by you and may be reclaimed if your account becomes inactive.

Number Portability: Virtual numbers provided by CallYou are generally not portable to other carriers.

Geographic Restrictions: Some virtual numbers may have geographic restrictions on their use.

5. Service Availability and Quality

Internet Dependency: Our Services require a stable internet connection. We cannot guarantee service quality if your internet connection is poor or unstable.

Service Interruptions: We strive to provide continuous service but cannot guarantee 100% uptime. Service may be interrupted for maintenance, upgrades, or due to circumstances beyond our control.

6. Emergency Services Limitation

IMPORTANT: CallYou VoIP Services are NOT intended for emergency calls. Our Services do not support traditional 911 emergency services. In case of emergency, use a traditional phone line or mobile phone to contact emergency services.

7. Payment and Billing

Fees: Certain Services may require payment of fees. All fees are non-refundable unless otherwise specified.

Usage Charges: Some services may be charged based on usage (per minute for calls, per message for SMS).

Account Suspension: We may suspend services for non-payment of fees.

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

9. Intellectual Property

CallYou and its licensors own all intellectual property rights in the Services, including software, trademarks, and other proprietary materials. You are granted a limited, non-exclusive license to use the Services for personal or business communications.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLYOU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

Our total liability to you for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid us for the Services in the 12 months preceding the claim.

11. Service Termination

Termination by You: You may terminate your account at any time by contacting our support team.

Termination by Us: We may terminate or suspend your account immediately if you violate these Terms or for any other reason at our sole discretion.

Effect of Termination: Upon termination, your right to use the Services will cease, and your virtual phone number may be reassigned.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Services after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where CallYou is incorporated, without regard to conflict of law principles.
